Des Moines Arts Festival 2017 Agreement

By executing this agreement, Applicant/Artist acknowledges having received and read the Des Moines Arts Festival® (DMAF) 2017 Prospectus/Application, and agrees to abide by all rules and standards set forth herein.



Applicant/Artist understands and agrees that by submitting this application, s/he consents to having read and accepts all rules, standards and expectations as described and inferred in the Prospectus and Application.



Applicant/Artist affirms the work submitted is their own and authorizes the use of any and/or all images of his/her work submitted through the jury process in promotional literature and/or other promotional endeavors by the DMAF for the stated purpose of promoting attendance to the DMAF and Artist. Said images may be used in any fashion at the sole and exclusive discretion of the DMAF. Such uses may include, but are not limited to: brochures of artists’ work that have been previously displayed or will be displayed, print advertisements, television advertisements and internet displays. Applicant further agrees that in consideration for participating in the DMAF, s/he hereby waives and releases the DMAF, its officers, directors and agents from any and all liability stemming from any use of the Artist’s work in any of the ways described above.



Applicant/Artist releases and forever discharges the DMAF, City of Des Moines, Polk County, all sponsoring organizations and their directors, officers, employees, agents and volunteers from any responsibility, personal liability, claims, loss or damage arising out of or in conjunction with application to or participation in the DMAF.



Upon acceptance, Applicant/Artist will be required to sign an Agreement, which will state in part that the DMAF is not responsible for any injury sustained by exhibitors or guests while within space designated for exhibits. Further, Applicant/Artist understands that storage and display of art is at his/her own risk without exception or limitation. Applicant/Artist agrees that the invitation to exhibit and participate in the 2017 DMAF will be withdrawn should the Applicant/Artist fail to sign the Agreement.



Applicant/Artist confirms that images submitted for jurying are representative of work to be exhibited and that the DMAF reserves the right, in its sole discretion, to advise Applicant/Artist of any work that does not meet the standards set forth, and Applicant/Artist agrees that such work will be immediately removed upon request by DMAF officials. Failure to remove such work or to abide by other rules set forth may result in Applicant/Artist’s removal from the DMAF and/or Applicant/Artist being prohibited from future participation. By signing this agreement the Applicant/Artist acknowledges that all the work submitted for jurying and subsequently exhibited at the DMAF if accepted is work created entirely by the Applicant/Artist.



The DMAF retains the right to prevent an Applicant/Artist accepted for exhibition from exhibiting for conduct deemed, in the DMAF’s sole discretion, unacceptable and/or detrimental to the mission and reputation of the DMAF. If the DMAF exercises its rights under this Rule in advance of the date of the Festival, the DMAF will provide the affected Applicant/Artist(s) notice of the DMAF’s decision in writing, to the address provided by the affected Applicant/Artist(s) in his/her application.
