Boardwalk Art Show 2018, 63rd Annual Agreement

I agree to abide by the Festival rules and regulations as established by the Festival Committee and the City of Virginia Beach.



I also warrant that the artworks submitted for jurying and the artworks to be shown were produced solely by myself or in collaboration with the co-artist in the category in which selected. I also authorize use of images submitted with my application or duplicates thereof for Festival publicity or documentation.



A picture ID is required at registration. The ID must match the name on the application. THE ORIGINAL APPLICANT MUST REGISTER. IN THE CASE WHERE A COLLABORATOR IS LISTED ON THE APPLICATION, HE/SHE MUST BE IN ATTENDANCE AND SHOW IDENTIFICATION AT REGISTRATION AS WELL. "PARTNERS" ARE PROHIBITED FROM REGISTERING FOR THE ARTIST.



A completed application is an agreement to show in your selected category(ies) and to abide by the Festival rules as stated in the legal agreement and show prospectus. No refund or exhibitor fee will be made for cancellation after April 15, 2018.



By this application, the undersigned (“Participant”), being of legal age or signing in conjunction with a parent or legal guardian if not of legal age, desires to participate in the Boardwalk Art Show, sponsored by the Virginia Museum of Contemporary Art (“MOCA”). Participant acknowledges that his/her participation or involvement, as an artist, vendor, and/or attendee, in the Boardwalk Art Show carries with it the potential for certain risks and liabilities. Being fully aware of the risks and inherent dangers in participating in the Boardwalk Art Show, Participant hereby elects voluntarily to participate and willingly enters into this Release, Waiver, & Indemnity Agreement (the “Agreement”).

Without limitation for any injury, death, loss, or damage caused to Participant and/or Participant’s property, Participant agrees to assume all risks inherent in and dangers intrinsic to his/her participation, including but not limited to (1) the purposeful, reckless, or negligent acts, of any kind or nature, by other participants or attendees; (2) the risks of failure or misuse of equipment or facilities; (3) certain hazards such as surface and subsurface conditions; and (4) weather, theft, or vandalism. Participant understands that this list is illustrative, not exhaustive; and acknowledges that he/she has been given notice of the risks inherent in and dangers intrinsic to his/her participation in the Boardwalk Art Show. Participant expressly agrees to assume all such risks and waives all rights to sue for any personal injury, death, loss or damage to personal property caused by such risks.

Therefore, in consideration of being permitted to participate in the Boardwalk Art Show, which Participant acknowledges is good and valuable consideration, Participant knowingly and expressly waives all rights to sue, and hereby agrees to indemnify and hold harmless, MOCA, its members, managers, employees, agents, volunteers, successors, heirs, and assigns from any and all loss, claim, suit, or judgment resulting from any personal injury, death, loss or damage to personal property claimed by or sustained to Participant or to Participant’s property; and further agrees to indemnify MOCA, its members, managers, employees, agents, volunteers, successors, heirs, and assigns from any and all costs of defending such claims, including attorneys’ fees.

If Participant is a minor or otherwise under a legal disability, this Agreement shall be signed by Participant’s parent or legal guardian. By application, the parent or legal guardian agrees (1) to waive the parent’s, guardian’s, and Participant’s right to sue; and (2) to assume, on behalf of the parent, guardian, and Participant, all obligations, duties, and risks set forth in this Agreement.

I have read this Release, Waiver, & Indemnity Agreement. I understand that by signing it, I give up certain rights I might otherwise have to recover damages for losses, death, or injury.
