National Cornbread Festival 2018 Agreement By applying to The National Cornbread Festival, I assume all responsibility for safeguarding my products and my display at The National Cornbread Festival on April 27 - 29, 2018.  As an exhibitor, any insurance on my property and goods is my sole responsibility.   As a vendor, I will be prepared to participate in the festival, rain or shine; however, I understand that The National Cornbread Festival has the right to close The Festival if any unforeseen circumstances occur that would affect the safety of the event attendees and/or vendors.   I agree to hold harmless The National Cornbread Festival, sponsors, partner organizations, coordinators, volunteers, or employees, for any damage, loss or injury resulting from my participation in this event.   I hereby certify that the work I will display and sell at The National Cornbread Festival will be original arts and crafts or home-produced articles (no commercial items or flea market wares). I agree to allow images of my work and likeness to be used in event-related publicity and/or materials.   I understand that no pets, alcoholic beverages or illicit drugs are allowed on the festival grounds.   I acknowledge and will fully comply with the rules of The National Cornbread Festival, as well as any and all federal, state and local laws. VENDOR CONTRACT   This agreement between NATIONAL CORNBREAD FESTIVAL (hereinafter referred to as “Festival”) and vendor-applicant as registered on application website, www.zapplication.com (hereinafter referred to as “Website”) WITNESSETH   Whereas, the National Cornbread Festival promotes a yearly festival on and about Cedar Avenue in South Pittsburg, Tennessee, to promote the City of South Pittsburg, its citizenry and its heritage.  This contract covers the dates April 27, 28 and 29, 2018. Whereas, the undersigned has agreed to be a vendor (selling crafts, and/or art, and/or food, and/or products); And whereas, the parties desire a written agreement: NOW THEREFORE IN CONSIDERATION of the above representations, the parties agree as follows: 1. The risk of injury from the activities involved in the program is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and 2. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releasees or others, and assume full responsibility for my participation; and 3. I willingly agree to comply with the stated and customary terms and conditions for participation.  If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and 4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release and hold harmless the Festival, their officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the event (‘Releasees’), with respect to all and any injury, disability, death, or loss or damage to person or property, whether from the negligence of the releasees or otherwise, to the fullest extent permitted by law. 5. Each party will be responsible for their own conduct and/or liability and will hold the other harmless for any conduct and/or liability incurred by the activity of the undersigned.  It is specifically understood that each party is an independent contractor/agent and the parties have no individual control and/or supervision over the other except to conduct themselves in a proper manner. The parties agree to abide by all government rules and/or regulations in regard to providing and/or selling their product.
