Best of the Northwest Spring Art and Fine Craft Show 2018 Agreement

2018 ARTIST AGREEMENT



1.Permitted items: The Artist agrees to sell, display or promote during an event only his or her own individually handmade products that are not mass-produced or made by an assembly line process, and are made by the artist(s) presenting the products at the event. Only US or Canadian-made reproductions are allowed in the categories of 2-D and photography; however, such reproductions cannot be more than 50% of the work displayed or offered for sale at the event. In addition, only craft products approved by the Northwest Art Alliance (NWAA) jury committee can be sold at the event. NWAA reserves the right to require the Artist to remove such non-approved items within one hour of the notice to remove. If the artist fails to do so, then NWAA can, without liability to the Artist, physically remove the Artist from the event, and the Artist shall have no right to a refund of any fees paid to NWAA and shall remain liable for any additional fees due to NWAA for that event.



2.Booth Structure: Booths shall be safely designed and installed, and in accordance with the best interest of the event, according to standards set by NWAA in its sole discretion. NWAA will prohibit the installation and operation of any booths not meeting their approval. Booths must stay within their assigned booth space. Canopy covers are not allowed for any indoor NWAA event. NWAA can, without liability to the Artist, physically remove the Artist from the event for installing a non-compliant booth, and the Artist shall have no right to a refund of any fees paid to NWAA and shall remain liable for any additional fees due to NWAA for that event.



Because of new City of Seattle fire regulations, all booth walls must be professionally treated and certified or be inherently fire resistant. The artist must be able to verify this with appropriate certificates and/or manufacturer’s tags. Self-applied treatments are not longer allowed. Refer to Seattle Fire Department Special Events for code requirements.



3.Show Hours: The Artist agrees to occupy the assigned space and be open and staffed during all regular event hours, and may not open late or close early. Any Artist not in compliance with this policy will not be invited to participate in future events.



4.Payment: All booth fees are due by the due date posted for that event. All booth fees are non-refundable and non-transferable. For indoor events, Artists whose payments are not received by this due date will be moved to the wait-list. 



5.Weather-Related Issues: Non-participation in events due to inclement weather is solely at the discretion of the participating Artist. Booth and other fees are not refundable or transferable for non-participation.



6.Liability: The Artist assumes all risk of loss or damage to the Artist’s property at any time while at the event. The Artist agrees to indemnify and hold NWAA, City of Seattle, and/or Seattle Parks and Recreation harmless from any and all losses, claims, actions, damages and expenses arising out of his/her performance or lack of performance under this Agreement. It is not required, but is strongly recommended that the Artist obtain his/her own property and liability insurance.



7.Compliance With Law: The Artist shall at all times comply with all applicable laws, ordinances, rules, and regulations and orders of federal, state, county, and city government.



The Artist shall be required to have any and all business licenses and other permits needed for his/her operations.



Artists exhibiting in Seattle are required to have a Seattle Business License and must furnish us with their permanent number. For Artists who do not have this license, the “Temporary Seattle Business License” check-box must be selected and paid for in Zapplication together with their booth fee and other services.



8.Media Rights: The Artist, by submitting images, consents to the use of the images in marketing and public relation materials for the purpose of promoting Northwest Art Alliance, including, but not limited to its Best of the Northwest events. The applicant certifies that all models appearing in such photos have signed photo releases that cover this consent, and agrees to hold NWAA harmless from any liability that may result from non-compliance. Photography credit will not be listed. If the photos are copyrighted, you must include a letter giving permission for Northwest Art Alliance to utilize them. The Artist agrees to allow NWAA to photograph or record any activity occurring during our events, including set-up and take down, and permits use of such photographs or recordings for promotional purposes only. All media access and relations shall be coordinated through NWAA prior to, and during the event.



9.Force Majeure: If all or part of the event is prevented from being held because of war, fire, strike, government regulation, public catastrophe, act of God, or other cause beyond the control of NWAA, NWAA shall determine and refund to the Artist his/her appropriate share of the aggregate booth fee received which remains after deducting all expenses incurred by NWAA related to the event. In no case shall NWAA be liable to the Artist for lost sales or any expenses the Artist incurs that are related to said event.



10.Invalidity of Particular Provisions: Should any term, provision, condition or other portion of this Agreement be held invalid or unenforceable, the remainder of this Agreement shall not be affected and shall continue in full force and effect.



11.Relationship Standard and Right To Termination: NWAA is a 501(c)(3) non-profit organization run for the benefit of artists. We rely on the goodwill and cooperation of all concerned. If NWAA, in its sole discretion, determines prior to an event that an Artist fails to exhibit behavior conducive to providing a supportive environment for all artists participating in the event, it reserves the right to terminate this Agreement, without liability to the Artist, and shall refund any booth and other fees thus paid, less a service charge of 30% of said fees. If the determination is made during an event, including load-in, NWAA shall provide the Artist with a verbal warning to correct his/her behavior. If it is not corrected immediately, NWAA can, without liability to the Artist, physically remove the Artist from the event, in which case, the Artist shall have no right to a refund of fees paid to NWAA and shall remain liable for any additional fees due NWAA for that event. The Artist will not be allowed to participate in future NWAA events.



12.Artist Cancellation / Refund: Notice of cancellation by the Artist of participation in any event must be provided to NWAA in writing. If provided 60 days or more in advance of the event, the Artist shall receive 70% of all fees paid to NWAA, excluding Application and/or Jury fee. If provided less than 60, but more than 30 days in advance of the event, the Artist shall receive 50% of all fees paid to NWAA, excluding Application and/or Jury fee. Notices received less than 30 days prior to the event will not be entitled to a refund.
