Legal Agreement

 

1. The ARTIST agrees that all work shall be created solely by the artist/collaborating artist, with no assistance of industrial production techniques and no imports or consignments of piecework items.

 

2. Reproduction PolicyIn an attempt to foster an appreciation and value of the arts in all people, including those who cannot afford original work, we believe it is important to offer the public the opportunity to buy reproductions, hoping that as their incomes grow they will turn to original work.  This transition is possible only if our patrons understand exactly what they are buying and the process behind it.  Towards this end, the following guidelines have been established.

  • All work must be original, handcrafted work. Artist guarantees the accuracy of the description of the works presented and the authenticity of the work as the creation of their own hands.

  • Work done by a production studio is not acceptable. All work must be designed and executed by the accepted artist.

  • No more than two artists may collaborate on work. Both must be included on and sign the application. Both must be present at the Utah Arts Festival.

  • Artists must be present with their work for the entire four days of the Utah Arts Festival. Representatives may not attend in place of the artist. The Utah Arts Festival requires photo identification at check-in to ensure compliance. 

  • Artists may only show work in categories and body of work selected by the Jury. All work exhibited must be of the quality, category and spirit of work of that shown in the images juried.

  • Only reproductions that comply with the Reproduction Policy are allowed (see special notes per media category). All reproductions must be clearly and individually labeled as such.  No other terms such as “print” or “offset lithograph” may be used. Labels must say “reproduction”


Media Categories - Media categories are used by the Arts Festival as a tool for organizing artists' images into logical, related groups for the jury's review. While a balanced show that equitably showcases both works of fine art and fine craft as well as diversity among media is a principal Utah Arts Festival objective, the Festival establishes no quota or entitlement by media category.

2-D and 3-D Mixed Media: This category includes works, both 2 and 3-dimensional, that incorporate more than one type of physical material to produce. This includes non-sculptural work as determined by the artist.

Ceramics: All original clay and porcelain work is accepted in this category. No machine-made or mass produced work is permitted. If multiple pieces of the same design are displayed each piece must be signed.

Digital Art and Digital Photography: This category includes any original work for which the original image, or the manipulation of other source material, was executed by the artist using a computer. Work in this category must be in limited editions, signed and numbered on archival quality materials.  Reproductions must be in signed editions of no more than 1000.

Drawing / Pastels: Works created using dry media including chalk, charcoal, pastels, pencil, wax crayon, etc. or from the fluid medium of inks and washes applied by pen or brush are to be entered in this category.

Fiber: All work crafted from fibers including basketry, embroidery, weaving, leatherwork, tapestry and papermaking. No machine tooling, machine-screened patterns or other forms of mass production are permitted. No factory produced wearable items, regardless of additional modification or enhancement by the artist, may be exhibited.

Glass: Items either kiln formed, hand blown, torched, slumped, etc. are included in this category.  No forms of mass production are permitted.

Graphics and Printmaking: Printed works for which the artist's hand manipulated the plates, stones or screens and which have been properly signed and numbered as a limited edition may be entered in this category. All photogravure, photocopy and/or offset reproductions will be rejected. Printmakers are required to disclose both their creative and printmaking processes. Reproductions must be in signed editions of no more than 1000.

Jewelry: All jewelry whether the work is produced from metal, glass, clay, fiber, paper, plastic or other materials must be entered in this category. No commercial casts, molds or production studio work is allowed. 

Metalwork: Includes all non-sculptural, non-jewelry works crafted from metals. Metals may be cast, hammered, or embossed to feature raised designs.  No production studio work is allowed.

 Painting: Works created in oils, acrylics, watercolor, etc. are in this category. Reproductions must be in signed editions of no more than 1000.

Photography: Photographs that have been digitally manipulated should apply in Digital Photography.  Photographic prints made from the artist's original negative and which have been processed by that artist, or under his or her direct supervision, are included in this category. Photographers are required to disclose both their creative and printing processes on prints. Reproductions must be in signed editions of no more than 1000.

 Sculpture: Three-dimensional original work done in any medium, including built up works in wood are included in this category.

Wearable Art: This category includes; clothing, handbags, scarves, hats, belts, shoes, etc.  No forms of mass production are permitted.

 Wood: Original works in wood that are hand-tooled, machine-worked, turned or carved are accepted in the wood category. 'Built up' wood belongs in the sculpture category.

 

3. The ARTIST agrees that images of work submitted to the Festival for selection purposes will remain the property of the Utah Arts Festival, to be used for archival, promotional, educational purposes only.  Additionally, the ARTIST agrees that the FESTIVAL shall have the right to record by whatever means it desires, the ARTIST, the booth, and the work.  The ARTIST further agrees that if the FESTIVAL does record said ARTIST, booth or work, that the FESTIVAL shall retain all rights to use such recording in promoting and advertising the Festival.

 

4. The ARTIST agrees that images of work submitted to the Festival may be used on the FESTIVAL website (www.uaf.org) and will be available free of charge to anyone in the world who has access to the World Wide Web; although these images will not be publishing quality due to the nature of the internet.

 

5. It is understood that the ARTIST must be in attendance for the length of the show.  If the ARTIST is unable to attend, his/her space will be forfeited.  ARTIST must produce photo ID when checking in at the Festival before setting up any equipment.

 

6. It is understood that artists are only allowed 200 watts of power per booth.

 

7. The FESTIVAL shall designate the artist booth type: modular display booth, or artist provided tent/canopy that does not exceed 10'X10‘.  The ARTIST agrees to comply with all applicable Salt Lake County fire safety regulations regarding display space and materials.  The ARTIST agrees to comply with all set-up, display, load-in/load-out and tear-down guidelines as established by the FESTIVAL, including access to booth, and vehicle restrictions.

 

8. The ARTIST understands that security for the work and property of the ARTIST will be the responsibility of the ARTIST.

 

9. Festival insurance does not cover loss or damage to artists' property or equipment.  The ARTIST agrees that any insurance required insuring his property or work shall be the responsibility of the ARTIST.

 

10.  The ARTIST waives, releases, and agrees to hold the FESTIVAL harmless from any and all liability, claims, damage, injury etc. arising or resulting from or caused by the ARTIST'S performance, or lack thereof, hereunder.

 

11. In the event that the ARTIST utilizes any Festival staff member or volunteer for booth relief, it is understood that said person shall not be held responsible for any theft, loss or damage to the ARTIST'S work, booth or goods.  It is also understood that said person shall not handle any sales or cash transactions or be asked to offer their services for more than 30 minutes.

 

12. The ARTIST shall be an independent contractor in performing pursuant to this Agreement, and shall not be an agent, servant, or employee of the FESTIVAL.  The ARTIST will remain open for business from Noon until 10 P.M. (ARTIST may stay open until 11:00 p.m. nightly), Thursday, June 21 through Sunday, June 24.  Artists may opt to close at 9:00 p.m. on Sunday, June 24.

 

13. It is understood that the ARTIST is solely responsible for payment of any and all taxes and licensing fees due Salt Lake City Corporation or the State of Utah.  ARTISTS name and address will be forwarded to said parties upon their request.

14. This Agreement contains the entire agreement between the parties.  No modification or amendment hereof shall be of any effect unless made in writing by both parties.  This Agreement shall be governed by the laws of the State of Utah.  The parties shall take such further action and execute such further documents as may be necessary to carry out the intent hereof.

 

15. It is understood that any policies, procedures or instructions that have been sent to Artist of the Festival at any time are considered a part of this agreement.

 

16. It is understood that if any provision in this contract is violated by the ARTIST, the Executive Director can eject the ARTIST from the FESTIVAL. The decision of the Executive Director is final.
