Artfest Spokane 2018 Agreement By executing this agreement, the artist states and acknowledges receipt of the ArtFest application and agrees to be bound by all rules and conditions set forth therein. The artist further agrees that images submitted for jurying are representative of work to be exhibited. ArtFest reserves the right to reject any application at its sole discretion. If ArtFest determines that work exhibited by the artist does not conform to the standards set forth by ArtFest, the artist agrees to remove such work from the booth space immediately upon request of ArtFest officials or representatives. Failure to remove such work or otherwise comply with all applicable rules and procedures may result in the immediate termination of the artist's participation without refund or recourse by artist. The artist agrees that images and artist information may be used by ArtFest for promotional purposes. The artist releases ArtFest from any and all liability on account of personal injury or property damages caused by theft, fire, weather, public catastrophe, acts of God or any other cause. The artist agrees to indemnify ArtFest if they suffer any loss or damage on account of any act on their part. The artist agrees that ArtFest, at its sole discretion, may prohibit the conduct of any activity whatsoever, which it deems detrimental or not in the best interest of the festival. The artist has read and agrees to abide by the terms and conditions of the festival and to obey the laws of the state of Washington and the city of Spokane. The artist understands that there are no refunds. ArtFest strongly recommends, but does not require, that all exhibitors/vendors carry liability insurance. Any personal injury to vendor or third parties or any property damage incurred in the course of this agreement shall be the sole responsibility of the vendor. Vendor agrees to indemnify, defend, and hold harmless the State of Washington and the Northwest Museum of Arts & Culture, its agents, employees, or any other covered group or individual against all costs, losses, damages, liabilities, expenses, demands and judgments, including court costs and attorney's fees. Vendor will not be covered by ArtFest insurance.
