Arts Alive! 2018 Agreement

I/we grant permission to Arts Alive 2018 to use submitted images for the purposes of promotional use, including, but not limited to: print, internet, press releases, and television. 



I/we certify that I/we are the artist(s) who creates the artwork and are not an artist representative or wholesaler.



I/we understand all booths will be visited by the viewing committee at intervals throughout the festival to ensure that all exhibitors comply with all festival rules. I/we further agree to abide by all regulations outlined in this application, the load-in and load-out instructions, security procedures, or any rule promulgated by Arts Alive 2018/the Art Center of Corpus Christi. I/we acknowledge that failure to abide by regulations and repeated non-compliance will result in expulsion and ineligibility for participation in future Arts Alive festivals. Expulsion of a participant from the Arts Alive festival is without the necessity of any written notice and without legal recourse or right to rebate any portion of the fees paid.



I/we participants, our heirs, successors and assigns agree to release and hold harmless the Arts Alive committee, the Art Center of Corpus Christi, its board of directors/governors, staff, sponsors, affiliated charity partners, volunteers and vendors and their heirs, successors, and assigns for any loss of property or physical harm, including, but not inclusive, of weather damage or cancellation due to weather. Exhibiting artists must take into account festival weekend weather conditions and make arrangements to protect their artwork and weight their booth tent against strong winds. Arts Alive is a non-refundable, rain or shine festival. In the event of severe weather the Art Center will monitor weather service reports and will alert exhibitors and patrons in the event of festival cancellation, and evacuation if necessary. The artist understands that the Art Center of Corpus Christi does not carry insurance to cover artwork and/or personal property. As an independent contractor, exhibiting artists are advised to obtain their own insurance.



Security will be provided from set up through breakdown, however, the Art Center of Corpus Christi is in an urban area, so reasonable precautions should be taken to ensure the safety of you and your property. It is recommended that each artist obtain general liability insurance, as the Art Center of Corpus Christi’s insurance does NOT extend coverage for booth damage or bodily injury.  Artists display all artwork at their own risk. The Art Center of Corpus Christi is not responsible for damage, theft, or loss of an artist’s property, or personal injury resulting from participation in Arts Alive 2018. In addition, the artist hereby releases and holds harmless the Art Center of Corpus Christi, the City of Corpus Christ, the Arts Alive committee and volunteers, all Sponsors and their directors, officers, employees, agents and volunteers from any and all liability including, but not limited to, theft, personal injury, strike, public enemy, or act of God and agrees to indemnify them for any damage arising from their conduct at Arts Alive 2018. The Art Center of Corpus Christi reserves the right to refuse any application and the right to make changes to the rules and regulations of Arts Alive 2018 at their discretion. 



I/we further agree to waiver any and all rights without limitation on liability for the use of the festival space and service described in this application.
