Festival for the Eno 2018 Agreement

THE UNDERSIGNED WILL COMPLY WITH THE FOLLOWING INFORMATION. THIS INFORMATION SUPERSEDES ALL PREVIOUS INFORMATION, WRITTEN OR VERBAL:

 

You will receive 3 participant passes for each day of the event and one limited access car pass to bring your materials on site before the gates open and to remove them at the end of the day.

 

Artist parking is off-site. We will provide shuttle transportation to and from the parking area for your convenience.  All vehicles must be removed from the site by 9 am each morning.

 

The undersigned agrees to pay the Association the amount of $190.00 for this craft vending space.  This payment should be made by sending a check or money order payable to Eno River Association along with one signed copy of this agreement to the above Festival address by May 1st, 2018.  There is no sliding scale or collection of fees at the Festival.  There will be no refunds of the fee made after May 15th, 2018.

 

All craft artist sites will be assigned by the Festival staff.  Craft artists are required to maintain their booths with adequate inventory for each day of the Festival.  Late arrival or early departure is not allowed.  Craft artists may not share or sublet their assigned space in whole or in part to any other vendor or exhibitor and must be present all of each day of the Festival.

 

Silk-screened or heat transfer printed clothing is not allowed. NO T-SHIRT SALES OF ANY KIND ARE ALLOWED.

 

The undersigned craft artist is currently a resident of NC, SC. VA, TN or GA.  If not currently a resident, the artist first participated in the Festival while a resident of North Carolina.

 

Merchandise must be consistent with those items that were presented to and accepted by the Festival Craft Jury.

 

All participants must be working craftartists who at least partially earn their livelihood through the practice of their craft.  Craft demonstrations at your booth are appreciated.

 

Craft artist assumes responsibility for all taxes, including sales tax, on items sold at or as a result of the Festival for the Eno.

 

The undersigned agrees to abide by Durham Fire Department rules concerning tent size and flammability.  All tents will be inspected and those which do not pass inspection must be removed.  In the event of this occurring, the Association will make no refund of fees or expenses to those involved.  See the fire regulations enclosed with this contract for further details.  

 

Craft artist agrees to take full responsibility for the protection of his or her goods and property in the event of adverse weather conditions.  Craft artist acknowledges that due to the scale of the event, there is no raindate.  The Association will not refund any fees or expenses in the event of adverse weather.

 

West Point on the Eno is a Durham City park.  No alcohol may be consumed in the park except in the designated Beer Garden.  There are no firearms allowed in the park.  The park closes at sunset - no camping.

 

The undersigned will not distribute literature or provide any advertisement for any organization unless the literature or advertisement is approved by the Board of Directors of the Association.

 

Craft artist will comply with all laws, ordinances, orders, decrees, rules, and regulations of any lawful authority, agency, or governmental unit which apply to the use of their vending unit during the Festival for the Eno, and agrees to indemnify and hold harmless the Association, its officers, directors, representatives, employees, agents, and sponsors for any penalties, fines, costs, expenses, or damages if the craft artist fails to do so.

 

The Eno River Association is not responsible for providing any liability insurance or any workman's compensation insurance for the personnel of the independent contractors operating craft booths.  The Association and the City of Durham are specifically exempt from any liability for any loss, accident, injury, or death to any personnel who are employed in the operation of any craft booth at the Festival for the Eno.

 

The Eno River Association and the City of Durham, their employees, agents or representatives shall not be responsible for any loss, damage, claim, or other injury to craftartist, his or her employees, agents or representatives, or to any property or goods of the same, whether caused by fire, theft, act of God, accident, or any cause whatsoever, for the period the craft artist or his or her property or goods occupy the site.

 

Craft artist assumes all responsibility for any loss, damage, claim or other injury to the craftartist, his or her employees, agents or representatives, or to any property or goods of the same, whether caused by fire, theft, act of God, accident, or any cause whatsoever, for the period the craft artist or his or her property or goods occupy the site, and shall indemnify and hold harmless the Eno River Associaton and the City of Durham, their employees, agents and representatives from any and all such loss damage, claim, injury or other expense relating thereto.

 

Craft artist acknowledges that constant surveillance of all areas is impossible and the craft artist must make provision for the safeguarding of his or her exhibits and other property from the time they are placed in his or her assigned place until they are removed from the site by the craft artist. The craft artist will be permitted to leave work and other property on site at the craftartist's sole risk.  The Association recommends the removal of inventory and valuable items when the Festival is not in operation.  The Association does not assume any responsibility for personal injury or for theft, loss, or damage to any goods or property of the craftartist.

The Association or craft artist may terminate this agreement at any time prior to May 15, 2018, by notice in writing from the party desiring the termination to the other party concerned.  After May 15, 2018 if the craft artist shall fail through any cause to fulfill in timely and proper manner the obligations under this agreement, the Association shall thereupon have the right to terminate this contract by giving notice to the craft artist of such termination.

 

I, the undersigned craftartist, have read, understood, and accepted the terms of this craft artist sale agreement and agree to abide by the regulations set forth by the Eno River Association and Durham Fire Department. I understand that if I or members of my staff violate these regulations my booth will be closed to the public with no refund of fees or expenses. Craft artist verifies that all information given the Association is accurate and acknowledges that failure to provide accurate information will result in the cancellation of this agreement by the Association at its option.  If any of the terms, conditions or provisions of this agreement are deemed unenforceable, the enforceability of the remaining terms, conditions or provisions shall not be affected.  This agreement shall be governed and construed in accordance with the laws of the State of North Carolina.
