Rockport Art Festival 2018 (Rockport, TX) Agreement Artist/Applicant agrees to the following terms set by the Rockport Art Association, Inc. (dba Rockport Center for the Arts): 1) FESTIVAL CANCELLATION: If the Rockport Art Festival is canceled, postponed or partially impaired, no refunds will be issued, nor shall the Rockport Art Association, Inc. dba Rockport Center for the Arts, be held liable. 2) SALES TAXES: Each artist is responsible for the collection and remittance of necessary sales taxes per artists' vendor license. Rockport Center for the Arts takes no responsibility for the collection and remittance of sales tax. 3) PERSONAL PROPERTY LIABILITY: Rockport Art Association, Inc. dba Rockport Center for the Arts assumes no liability for exhibitor's property, including any damages caused by weather. 4) USE OF SUBMITTED IMAGES: By answering "Yes" to the "Use of Submitted Images" Question, Rockport Art Association, Inc. dba Rockport Center for the Arts may use images submitted by artist/applicant for the Rockport Art Festival in promotional materials, including but not limited to print advertising, website and online news media outlets, and television publicity. Rockport Art Festival may hire a publicist to promote exhibiting artists (whose images are used) in their hometown newspaper. Artist/Applicant agrees that this is fair compensation for use of submitted images. 5) ARTIST/APPLICANT AGREEMENT: Artist/Applicant agrees to abide by terms set forth in the event description, and to follow all instructions made by official Art Festival Staff. This application is a commitment to participate in the Festival if invited, that all exhibited work will adhere to all Eligibility and Standards requirements, all artwork on display will be for sale, and that artist/applicant will be present at all times during each day of the Rockport Art Festival. 6) ARTIST/APPLICANT RELEASE OF LIABILITY: By submitting this application, artist/applicant hereby releases Rockport Art Association, Inc., dba Rockport Center for the Arts from all claims, demands, damages, actions, debts, liabilities and causes of action of every nature which the undersigned might have against the above by reason of damage, loss, theft, or injury to person or property, or both, resulting from the entry by the artist/applicant on Rockport Art Festival grounds.
