The Dayton Art Institute, Oktoberfest 2018 Agreement Exhibitor understands and agrees that neither The Dayton Art Institute, nor the Associate Board, nor any other person connected with either, assumes any responsibility for the condition of the premises or for any act or omission of any person whosoever. Exhibitor hereby releases The Dayton Art Institute, the Associate Board and all persons connected with either from any and all claims of any kind whatsoever arising from or in any way connected with this concession and/or said event, including any negligent act or omission on the part of any person whomsoever, including The Dayton Art Institute, the Associate Board, and any and all persons connected with either, excepting only any claim for deliberately inflicted injury against any person inflicting such injury. Exhibitor hereby agrees to indemnify and hold harmless The Dayton Art Institute, the Associate Board and all persons connected with either from any loss of expense in connection with any claim for injury or damage to the person or property of Exhibitor or Exhibitor’s agents, servants and invitees, even though some act of omission, negligent or otherwise, of The Dayton Art Institute, the Associate Board or some person connected with either may be or alleged to be a cause of injury or damage, and further to assume the defense of The Dayton Art Institute, the Associate Board and all other persons connected with either as to all such claims and after all such actions thereon. Exhibitor hereby agree to exhibit work that is original and handcrafted by self in the media in which exhibitor is registered. Exhibitor agrees to exhibit only the type of work submitted for jury and only the type of work approved by the jury. Exhibitor also agrees to the rules, regulations and procedures of Oktoberfest.
