Creekside Music + Arts Festival 2018 Agreement CANCELLATION/REFUND POLICY: Cancellation of space: Application fees are not refundable. The Flagler County Chamber is not liable if weather or other conditions prevents the Exhibitor from attending and fulfilling the contractual obligation as an Exhibitor. No refunds will be made for weather, accident, health or other causes for non-participation, attending and fulfilling the contractual obligation as an Exhibitor. WEATHER - This is a rain or shine event. In the case inclement weather or other acts of god prohibits the festival, NO REFUNDS will be issued. The rain date for the event will be November 10 and 11, 2018 if park conditions are acceptable by the Flagler County Government Parks & Recreation department.   LIABILITY - The owner or custodian of property of any kind brought to the grounds either for exhibit or for sale or for any other purposes assumes, as a condition of its admission to the grounds, all risk and/or responsibility for its loss, damage or theft. The Flagler County Chamber of Commerce and its officers cannot and will not accept responsibility and liability for any damage or injury resulting from theft, fire, the elements, accidents, or any other conditions or causes, whether to exhibits, property of exhibitor and/or vendors, vehicles on the grounds and articles left therein, and any other property of any nature whatsoever. HOLD HARMLESS: In consideration of the opportunity to participate in the Flagler County Chamber Creekside Festival, I/we hereby release Flagler County Chamber of Commerce and the Flagler County Board of County Commissioners, its directors, officers, officials, superintendents, event sponsors, members, agents, employees and volunteers, from loss or damage to property and for personal injury and/or death resulting from my/our attendance and/or participation in the Flagler County Creekside Festival on October 6 & 7, 2018. I/we understand and agree to all terms and conditions of the above rules and guidelines. I certify that I am the original creator of the artwork listed above and agree to the rules as given on this document. I also agree to allow my artwork to be published if it is chosen for an award or photographed by local press.  Exhibitors are responsible for making their tents sturdy against wind, rain, etc.  Tents MUST be manufactured of flame-retardant materials.
