Pigeon Key Art Festival 2019 - 25th Annual Agreement LEGAL AGREEMENT Risk & Liability: The Artist/Vendor agrees to hold harmless Pigeon Key Foundation, Pigeon Key Art Festival (PKAF), Daily Plan-it, the City of Marathon, FL, the County of Monroe, FL and any of its employees, directors, subcontractors, or volunteers from any damage, loss or disappearance of exhibitor’s property or any personal injury he/she or assistants may sustain during the event, including travel to and from the event (including air travel) or any events incidental to this event. It is the responsibility of the Artist/Vendor to incur any and all expenses associated with any and all claims, loss or damage to personal property, liabilities and costs, including attorney’s fees, as a result of participating in this event. Artists/Vendors are responsible for purchasing their own insurance to cover their personal property, personal liability and artwork. Artists/Vendors are responsible for taking precautions to protect their work from theft, damage, weather conditions and acts of God. The producer reserves the right to cancel the event due to acts of God, weather, terrorism or unforeseen events out of the producer’s control, in which case, Pigeon Key Foundation, Pigeon Key Art Festival, Daily Plan-it will not be liable for refunds or other liabilities. PKAF may use Artisan’s/Vendor’s submitted images for promoting, advertising and marketing purposes only. The Artist/Vendor hereby agrees that he/she has read this agreement as well as all information in the application, and agrees to abide by the policies, regulations and guidelines contained therein. I agree to abide by all payment and cancellation schedules. I understand that the application fee and deposits are non-refundable once accepted. I further consent to the enforcement of all PKAF rules as set forth in the application Terms and Conditions of Participation and in any subsequent correspondence.
