Salida Arts Festival 2019 Agreement By executing this agreement, Artist states and acknowledges receipt of the Salida Arts Festival Application, incorporated herein by reference and agrees to be bound by all rules and conditions set forth therein. Artist further agrees that images submitted for review by the 2019 Salida Arts Festival jury are representative of the work to be exhibited at the festival. If Salida Arts Festival determines, in its sole discretion, that any work exhibited by Artist(s) does not conform to the standards set forth by Salida Arts Festival, Artist(s) agrees to remove such work from the booth space immediately upon request of Salida Arts Festival officials or representatives. Failure to remove such work or otherwise comply with all applicable rules and procedures may result in the immediate termination of Artist’s participation, without refund to or recourse by Artist(s).   ·      Artist(s), our heirs, successors and assigns agree to release and hold harmless the Salida Arts Festival, its board of directors, staff, sponsors and affiliated charity and corporate partners and their heirs, successors, and assigns for any loss of property or physical harm. Artist further agrees to waive any and all rights without limitation on liability for the use of the festival space and service described in this application. Artist understands that the Salida Arts Festival does not carry insurance to cover Artist’s personal property and agrees that as an independent contractor, Artist will obtain his/her own insurance. Artist understands that he/she stores art work throughout the Fair, including overnight, at his/her own risk without exception or limitation.   ·      Artist understands that there are no refunds or rain checks due to inclement weather or other acts of God. In consideration of the Salida Arts Festival’s acceptance of his/her application, Artist agrees to allow the Festival’s use of attached images, promotional materials and photographs taken during the Festival for promotional purposes.   ·                           Artist understands that Festival rules and regulations include without limitation those set out in the Festival Prospectus agreement, load-in and load-out instructions, security procedures, and any rule promulgated by the Festival Director. Artist acknowledges that failure to abide by regulations and/or repeated non-compliance may result in expulsion and ineligibility for judging, awards, and participation in future Festivals. Expulsion of an Artist from the Festival is without the necessity of any written notice and without legal recourse or right to a refund of any portion of the fees paid. Artist understands that all booths will be visited by the Festival committee at intervals throughout the Festival to ensure that all artists comply with all Festival rules.
