Bayou City Art Festival Downtown 2019 presented by Art Colony Association Agreement

I/we grant permission to the Art Colony Association, Inc., to reprint an image for promotional use of the Bayou City Art Festival. This includes, but is not limited to the use in press releases, print, television, and the festival website.


 

I/we certify that I/we am/are the artist who creates the work I/we sell and not an artist representative or wholesaler.


 

I/we understand all booths will be visited by the viewing committee at intervals throughout the festival to ensure that all exhibitors comply with all festival rules. I/we further agree to abide by all regulations outlined in this application, the load-in and load-out instructions, security procedures, or any rule promulgated by the Producers. I/we acknowledge that failure to abide by regulations and repeated non-compliance will result in expulsion and ineligibility for judging, awards, and participation in future Art Colony Association, Inc. festivals. Expulsion of a participant from the Art Colony Association, Inc., festival is without the necessity of any written notice and without legal recourse or right to rebate any portion of the fees paid.


 

I/we participants, our heirs, successors and assigns agree to release and hold harmless the Art Colony Association, Inc., its board of directors, staff, sponsors, affiliated charity partners, volunteers and vendors and their heirs, successors, and assigns for any loss of property or physical harm, including, but not inclusive, of weather damage or cancellation due to weather. Exhibiting artists must take into account festival weekend weather conditions and make arrangements to protect their artwork and weight their booth tent against strong winds. The Bayou City Art Festival Downtown is a rain or shine festival. In the event of severe weather the Art Colony Association, Inc. Board of Directors will monitor weather service reports and will alert exhibitors and patrons in the event of festival cancellation, and evacuation if necessary. The artist understands that the Art Colony Association, Inc., does not carry insurance to cover artwork and/or personal property. As an independent contractor, exhibiting artists are advised to obtain their own insurance.


 

Security will be provided during setup, Festival operating hours, and breakdown. However, Bayou City Art Festival Downtown is in an urban area, so reasonable precautions should be taken to ensure the safety of you and your property. It is recommended that each artist obtain general liability insurance, as the Art Colony Association’s insurance does NOT extend coverage for booth damage or bodily injury.  Artists display all artwork at their own risk. The Art Colony Association is not responsible for damage, theft, or loss of an artist’s property, or personal injury resulting from participation in Bayou City Art Festival Downtown. In addition, the artist hereby releases and holds harmless the Art Colony Association, the City of Houston, all Sponsors and their directors, officers, employees, agents and volunteers from any and all liability including, but not limited to, theft, personal injury, strike, public enemy, or act of God and agrees to indemnify them for any damage arising from their conduct at Bayou City Art Festival Downtown. The Art Colony Association reserves the right to refuse any application. Art Colony Association reserves the right to make changes to the rules and regulations of Bayou City Art Festival Downtown at their discretion.


 

I/we further agree to waiver any and all rights without limitation on liability for the use of the festival space and service described in this application.
