Washington Art + Design 2019 Agreement TERMS AND CONDITIONS OF PARTICIPATION By submitting my entry form, I agree to abide by all payment and cancellation schedules and other terms as set forth by The Pomeroy Group (the company). I understand that by submitting the entry form, I am signaling my commitment to participate in Washington Art + Design, to be held August 23, 24, 25, 2019 at the Walter E. Washington Convention Center in Washington, DC. PERMISSION TO CHARGE CREDIT CARD FOR INITIAL PAYMENT If I have provided a credit card number as part of my participation agreement, I understand and agree that show management has my permission to charge my credit card account upon receipt of this paperwork in the amount of $500 as th initial payment toward my booth fee. PERMISSION TO CHARGE CREDIT CARD FOR REMAINING BALANCE By submitting this form I hereby agree that following my initial $500 payment, the remaining balance will be charged to my credit card as follows: April 10 , 2019 – $500.  July 1, 2019 – balance of booth fee and jewelry lockup if ordered. INITIAL PAYMENT IS NON-REFUNDABLE AFTER 3 DAYS I understand and agree that my initial payment for my booth fee is non-refundable after 3 days of submission of the contract. SUBSEQUENT PAYMENTS NON-REFUNDABLE I understand that payments submitted as detailed above are non-refundable for any reason. INVOICES AND NOTIFICATIONS I understand and agree that if paying by check, an invoice will be issued, otherwise I will be notified when my credit card is charged. PERMISSION TO USE MY IMAGES FOR PUBLICITY PURPOSES The Pomeroy Group and Washington Art + Design has my permission to use the images I submit for the purpose of promoting, advertising and marketing. RELEASE OF LIABILITY I hereby release and forever discharge JPParssi, Inc., The Pomeroy Group, Washington Art + Design, all sponsoring organizations and their directors, officers, employees, agents and volunteers from any responsibility, personal liability, claims, loss or damage arising out of my participation in the show. ENFORCEMENT I further consent to the enforcement of all of Washington Art + Design's rules as set forth in the entry Prospectus and in any subsequent correspondence. LIABILITY AND INSURANCE Washington Art + Design will provide 24-hour security inside the venue; however, each artist exhibits at his or her own risk and should carry appropriate insurance. JPParssi, Inc., The Pomeroy Group, Washington Art + Design and/or the Walter E. Washington Convention Center or DC Events are not responsible for damage, theft or loss of an individual's work or belongings. A secured overnight lock-up will be available to jewelers at an additional charge. As a condition of my participation in Washington Art + Design, I agree to bear all risk and expense and to hold harmless and indemnify the Washington Art + Design, show management and all others associated with the event for any loss, theft, or damage to my artwork or other personal property, or injury to my person, regardless of cause.  SALES TAX OBLIGATION I am responsible for collecting and reporting the Washington DC sales tax (6%) on any sales. DISPUTES The company tries to provide clear terms and conditions so that we can limit or hopefully avoid disputes between you and us. If a dispute does arise, however, it's useful to know up front where it can be resolved and what laws will apply. For any claim, cause of action, or dispute I have against the company that arises out of or relates to these Terms ("claim"), I agree that it will be resolved exclusively in the U.S. District Court for the Southern District of Indiana or a state court located in Hamilton County, Indiana. I also agree to submit to the personal jurisdiction of either of these courts for the purpose of litigating any such claim, and that the laws of the State of Indiana will govern these Terms and any claim, without regard to conflict of law provisions. All costs for legal action you bring will be borne by me. OTHER If any portion of these Terms are found to be unenforceable, the remaining portion will remain in full force and effect. If we fail to enforce any of these Terms, it will not be considered a waiver. Any amendment to or waiver of these Terms must be made in writing and signed by us.   By submitting my entry form I agree that each item displayed will be my unique and original artwork, and to abide by all the rules and regulations set forth.
