Whitefish Arts Festival 2019 Agreement

By applying, the artist signifies that, upon acceptance to the Whitefish Arts Festival (WAF), the applying artist is 18 years of age or older, agrees to be present during all show hours, and will abide by all WAF, State of Montana, City of Whitefish, and festival rules, regulations, procedures, and guidelines.



All application/jury fees are non-refundable. Registration/booth fees are refundable diminishing to 45% if artist cancels by June 6th, 2019. There will be no holdovers of fees until the next year.   



By applying, the artist signifies that the construction park map of Depot Park for 2019 has been review and the artist is aware of the diminished access to the park for both set up and event days.



Whitefish Arts Festival recommends all exhibitors/artists to carry liability insurance.  Booth artists shall not be covered by WAF Insurance. Booth artists shall be responsible for determining what insurance is necessary in order to perform the work contracted for, and for procuring such insurance, and shall procure all licensing and insurance required by law.

 

Any personal injury to vendor or third parties or any property damage incurred in the course of this agreement shall be the responsibility of the booth artist. Artist agrees to indemnify, defend, and hold harmless the State of Montana, the City of Whitefish, the Whitefish Arts Festival, and Whitefish Christian Academy, its agents, employees, volunteers, or any other covered group or individual against all costs, losses, damages, liabilities, expenses, demands, and judgments, including court costs and attorney’s fees, which may arise out of booth artist's performance hereunder, except to the extent such are caused by the gross negligence of WAF.







Whitefish Arts Festival reserves the right to remove any artist from current or future shows at their discretion or for breach of event participation rules, regulations, procedures, guidelines, and legal agreements including violation of applicable laws of the City of Whitefish, Whitefish Christian Academy, the State of Montana, or for disruptive or abusive behavior.
