[Smash] Spring Fine-Arts Festival 2019 Agreement





* Castle Pines Property LLC [880 W. Happy Canyon Rd., Castle Pines CO 80108] nor Smash in the Square LLC will be responsible for damage to artists' work or set-ups due to weather or unrelated incidents. 

* Castle Pines Property LLC [880 W. Happy Canyon Rd., Castle Pines CO 80108] nor Smash in the Square LLC will be held liable for any loss/theft of artists' artwork.  There will be Overnight Security Friday May 17th & May 18th.  All artists are required/recommended to lock-up & secure tents/booths overnight to prevent unexpected/unforeseen theft of property. 

* Submission of an application + booth-payment (coordinated upon acceptance between the festival & each individual artist via PayPal or check) is a commitment to participate in the 2019 [Smash] Spring Fine-Arts Festival.

* Upon booth payment artist agrees to submit at least 1 piece of artwork into the [Smash] Fine-Arts Auction, therein artist sets own minimum bid and allows Smash in the Square LLC to upload artwork onto online bidding platform + handle sales for said auction item(s).  If artist's artwork doesn't sell online, artist is obligated to showcase/display auction item(s) at the live festival show (May 18/19).  If auction item is sold at the event, artist agrees to manage art exchanges (at or after the event) with highest bidder w/ Smash in the Square LLC managing final payments.  Within a month after the event, Smash in the Square LLC agrees/commits to compensate artist 80% of the total bid-sale from auction item(s).  

* The applicant(s) certifies that he/she/they will be in attendance for the entire show.  I/we grant permission to the [Smash] Festival to reprint an image for promotional use of the [Smash] Festival.  This includes the use in press releases, print, television, social media, and the festival web-site.   I/we certify that I/we am/are the artist who creates the work I/we sell and not an artist representative or wholesaler.  I/we understand all booths will be visited by the viewing committee - event director - at intervals throughout the festival to ensure that all exhibitors comply with all festival rules.  I/we further agree to abide by all regulations outlined in the show's application/guidelines, the load-in and load-out instructions, liability insurance requirements, security procedures, or any rule set forth by the event director.  Once booth payment is submitted, no refunds can be made, unless for unforeseen circumstances the [Smash] Spring Fine-Arts Festival is cancelled - then Smash in the Square LLC will reimburse artist 100% of booth-fee.  I/we participant(s) agree to release and hold harmless [Smash] Fine-Arts Festival (Smash in the Square LLC), Castle Pines Property LLC [880 W. Happy Canyon Rd., Castle Pines CO 80108] for any loss/damage of property or physical harm.  I/we certify that I/we have read and agree to all aforementioned rules and regulations. 

* By signing (agreeing to) this contract the participating artist/applicant agrees to the terms & conditions stated above + has read and understands the requirements (*Artist Guidelines/Expectations) for participation in [Smash] Fine-Arts Festival May 18th & 19th 2019.
