Venice-Nokomis Rotary Art Festival Legal Agreement

 

By applying online, you agree to indemnify, hold harmless and defend the Venice-Nokomis Rotary Art Festival including all of its officers, members, volunteers, partners, sponsors, vendors, and the City of Venice against any and all liability claims, cost of whatever kind and nature, for injury to or death of any person or persons and for loss and damage to any property in any way related to or arising out of your  occupancy and/or use of premises or any services and equipment at the Festival.

 

You hereby certify that all display work is handcrafted and created by you, the artist. You understand that the display of any mass produced item may result in your immediate expulsion from the Festival and you being declared ineligible for future shows. You understand that the Festival reserves the right to require you to remove all work that does not meet standards or is not consistent in style or subject matter with the images submitted in your application to the Festival. Your refusal to remove such items immediately upon request, will result in your immediate expulsion from the Festival. All decisions relating to the display of items and expulsion from the Festival shall be made in the sole and absolute discretion of the Venice-Nokomis Rotary Art Festival.

 

You agree to abide by the rules, policies and guidelines developed for the Venice-Nokomis Rotary Art Festival as stated on the www.zapplication.org website, in this Venice-Nokomis Rotary Art Festival application and in all future correspondence. You acknowledge and accept that failure to follow these regulations may result in expulsion from the Festival and you being declared ineligible for any future Festivals. All decisions relating to the interpretation of and any violation of the Festival rules and policies shall be made in the sole and absolute discretion of the Venice-Nokomis Rotary Art Festival. You agree to hold harmless, release and waive any claims against the Venice-Nokomis Rotary Art Festival, its officers, members, and volunteers, relating to and arising out of your failure to comply with the rules, and policies of the Festival and any decisions of the Venice-Nokomis Rotary Art Festival related thereto, including but not limited to any claims for any consequential, indirect, incidental, special, punitive or other damages.

 

There are no rain dates. All refunds or credits if a show is cancelled due to rain, floods, hurricanes, or any other acts of God will be at the sole discretion of the Venice-Nokomis Rotary Art Festival. There will be no refunds on artist cancellations. Credit, good for one year, will be issued if the Venice-Nokomis Rotary Art Festival is notified in writing at least (45) FORTY-FIVE days prior to the event.

 

If accepted, you agree that photographs submitted by the artist during the application process and/or images taken during the event which may include the artist, their booth, or their work may be used by the Venice-Nokomis Rotary Art Festival for promotional or publicity purposes.

 

You understand that the Festival is located and produced on festival Gounds owned and operated by the City of Venice, Florida.

 

I have reviewed the show information, rules and regulations and agree to the terms. Submitting my work for the jury process and subsequently paying a booth fee to participate in the Festival are done with full acknowledgement of, and agreement to these terms.
