Delray Affair 2020 — 58th Annual Agreement

Applicant seeks to participate as an Exhibitor at The Delray Affair, sponsored by the Greater Delray Beach Chamber of Commerce (the “Chamber”) and organized on the Chamber’s behalf by Festival Management Group (“FMG”).   The Applicant and Applicant’s heirs, executors, administrators and assigns (collectively the “Applicant”), hereby agree to release, indemnify,  defend, and hold harmless the Affair, the Chamber and FMG, along with the City of Delray Beach, any and all sponsoring organizations, parent companies, subsidiary companies, divisions and affiliates (collectively the “Entities”), along with all of their past and present officers, directors, agents, representatives, vendors, employees, volunteers and any other parties for which they may be responsible, (collectively the “Releasees”) from any and all claims, liabilities, demands and cause of action, know or unknown, fixed or contingent, rights or benefits of whatever nature or description, including any claims for attorney’s fees and expenses, arising out of the execution of this Agreement, including claims, liabilities, demands, and causes of action related to personal liability and property damage which the Applicant may have or claim to have against the Releasees arising out of the Applicant’s application and/or participation in The Delray Affair, except those caused solely by the intentional acts of the Releasees.



If accepted, The Delray Affair, the Chamber and/or FMG reserve the right to use Applicant’s artwork through the images submitted for promotional purposes, including advertising, publicity, marketing, web-based distribution outlets including social media for the show. No compensation will be given for use of any images. I agree to abide by all payment and cancellation schedules.  Applicant understands and agrees that the application fee and deposits are non-refundable once accepted.  Applicant further consents to the enforcement of all event rules as set forth in the application Rules & Regulations and in subsequent correspondence.
